Genius Lockers User Terms & Conditions

 

1.     Definitions
SMART LOCKERS: unit designated for people to leave luggage and/or small personal items, for a fixed duration;

DEPOSITOR: the individual using the smart locker service. The smart locker service consists in storing luggage/items in an automatic locker from the day and time they are left until the day and time they are collected.

GENIUS SMART LOCKER LLC: A company incorporated and existing under the laws of the Dubai, United Arab Emirates, with License No. 1358483, having its registered office at Office No. G-93, Sabha Building, Jabal Ali Industrial First, Dubai, United Arab Emirates

MASTER UNIT: A touchscreen computer which controls access to the lockers and offers a platform to making a booking.

HOST BUILDING: The physical location where the lockers are installed.

ACCESS CODE: A 6-digit code created by the depositor when making a booking allowing access to the selected locker size, in the selected location for the agreed duration.

2.     Items permitted in the smart lockers.

Lockers are intended for the storage of suitcases, hampers, bags, travelling bags and the like, keys, personal items, documents. All luggage must be closed properly. In any case, Genius Lockers LLC shall not be liable for money, jewellery, precious metals, business documents and valuables in general placed in the individual lockers which, as indicated below are not permitted to be stored.

The Dispositor agrees that items will not exceed the capacity of an individual locker.

The Depositor agrees that luggage or items stored in the locker does not contain any of the following items:

Luggage containing goods or materials that are easily flammable, perishable, give off strong odours or that could cause a deterioration of the Smart Locker infrastructure or damage to other luggage stored on the premises.

·       Money, jewellery, precious metals, business samples and documents and valuables in general.

·       Items weighing more than 32kg total.

·       Living animals or plants

·       Items prohibited by law such as stolen goods, narcotics, or weapons.

·       Items that could, by their very nature or packaging, cause harm to people, the environment or to other luggage being stored are not permitted.

·       Perishable items and foodstuffs

·       Trash

·       Materials that could be considered pornographic or indecent.

3.     Access

Locker access times are determined by host buildings, please check with the building management for details.

The dispositor may access the lockers at any available time to remove and add items during their usage period. In this case the dispositor should enter their code on the master unit and select temporary access

Access to the luggage storage is permitted to persons above 18 years old and accompanied minors.

4.     Reclaiming Items

At the end of the agreed term of use the depositor is responsible for collection of all items from the smart locker, and ensuring the end service option is selected on the master unit.

The depositor must not leave anything in the locker when collecting their items and leaving Smart lockers for the last time.

9.    Early Reclaiming

If the depositor reclaims the luggage and ends the service during a period for which payment has been made, no pro rata refund will be made.

5.     Left Luggage & Overstay

If the depositor does not collect their luggage and end service by the agreed time they are required to pay overstay fees before retrieving their items. If the overstay time reaches 7 days Genius Lockers LLC will remove any items in the lockers and store them at its warehouse for a period of 90 days. To collect the items the depositor agrees to pay the overstay warehouse fee as outlined in section 9, as well as any fees outstanding for locker usage. If the items are not collected within this timeframe Genius Lockers LLC will deem the luggage abandoned and may sell it to pay for outstanding storage fees, and hold the balance (minus reasonable costs of sale) for the depositor, or otherwise dispose of the luggage as they see fit.

If the depositor overstays 1 minute to 6 hours they will be charged the 6 hour rate. If the depositor overstays 6 hours 1 minute to 12 hours they will be charged the 12 hour rate. If the dispositor overstays 12 hours 1 minute to 24 hours they will be charged the 1 week rate. If the dispositor overstays 7 days 1 minute more longer they will be charged the 1 month rate.

If the depositor is unable to collect the items from the locker for any reason, they can call Genius Lockers LLC telephone support who will arrange for items to be couriered with all associated costs being paid in advance by the depositor.

6.     Security and Assistance

The Smart Lockers are equipped with 24/7 video surveillance, where required this will be directly linked with law enforcement.

7.     Access for Service

Access to the Smart Lockers is always permitted to the staff of Genius Lockers LLC who oversee and manage the service and to officers of law enforcement. The customer accepts that these officers have the right to open and inspect the luggage at any moment for security reasons.

8.     Leaving luggage and personal items for storage

Locker booking can be made directly from the master unit.

The Depositor pays the storage in advance as laid out in section 9.

The Depositor is responsible for ensuring that the locker door is secured properly when leaving items in the Smart Locker

9.     Return to Someone Other Than the Storer

The depositor creates their own 6-digit access code for using the smart lockers and is liable for loss or misuse of that pin-code. The items will be available for collection when the access code is entered regardless of the retrieval person.

10.  Charges & Term

The charges for use of the lockers are established by Genius Lockers LLC, and are displayed on when booking a locker, all charges are inclusive of VAT

Overstay Warehouse Fee – AED 30 per day.

11.  Liability

Genius Lockers LLC offers locker rental services and is not responsible for safeguarding user belongings. Clients are solely responsible for the items stored in rented lockers.

However, Genius Lockers LLC holds an insurance contract benefitting users, covering theft losses up to a maximum amount of AED 2,000. To avail themselves of this benefit, users must meet requirements outlined in the policy and collaborate with Genius Lockers LC in filing a claim with the insurer. In case of theft, users must file a complaint with the authorities without exception, and report the theft via the help desk number as soon as they become aware.

This insurance does not cover the loss of money, jewellery, gemstones or metals, watches, and, in general, technological items (LCDs, GPS navigators, cell phones, computers, tablets), art objects, antiques, memory cards, or any other media containing data or images.

12.  Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

13.  Agreement

By using the lockers, the Depositor fully accepts all the terms and conditions.

Genius Lockers LLC reserves the right to amend these terms and conditions in light of experience and needs that may arise during actual performance of the activity covered by these terms and conditions.
